In most localities it is necessary to file a complaint with the appropriate criminal justice officer such as a sheriff or district attorney to initiate criminal legal action.
So, if I have the money in the bank already, can I make the check dated for the day it is due, but send it 7 days ahead instead so they can stop complaining? Should I get, in writing, their pledge not to cash the check until the day it is due, or something? That will give you a solid record of payment as well.
Your ex needs to work out her own cash flow issues.
In other states it is a criminal offense to issue a bad check with intent to defraud or with knowledge of insufficient funds.
The intent to defraud and knowledge of insufficient funds is required to be present by most states' bad check laws. It is not necessary for the payee to have actually been defrauded.
UCC Subsection 4-401 states that "a bank may honor an otherwise properly payable postdated check before its date unless the customer has given the bank reasonable notice of the postdating." The notice of postdating is simply a means by which you can place the bank on formal notice that you've written a postdated check, and it orders the bank not to pay the check before the date written thereon.
If, after reasonable notification, the bank makes payment before the pay date on the check, it could be held liable for losses occurring due to its actions. I hope that you find this information to be helpful and this answer to be ACCEPTable!
I always put the alimony check in the mail 4 days before it is due. I know I can pay for things on venmo with my debit card and I'm not charged any additional fees.
Ex complains that I'm not sending the checks in time for ex to cash it on the day it is due and sometimes acrues late fees for their bills. so My direct deposit has her money go right to her on payday, works out wonderfully. I have to stop her direct deposit for a week or so when my deposit comes in because payroll is payroll and is split no matter what type. It would require her to set up an account as well but it would avoid sharing bank information and everything Ive done processes very quickly.
I gave the Mortgage company which is affiliated with bank of america instructions on when to cash each check submitted.it is legal for the Mortgage company to hold checks and submit when ever they want too??
My bank Bank of America rejected the check and then the mortgage company put it right back through two days later for payment there was still not enough monies in my bank account to cover so my bank had the legal right to honor it even though they orginally rejected it..
